I think MySql 4.0 may not be available on the MySql site anymore. I want to post it for download, but I want to make sure it's not illegal to do this.
Can any one tell me if this is ok?

I think you might be right. I cannot find 4.0.23 anywhere obvious. Since it is open source, and you won't be repackaging or changing the content and calling it yours, I see no reason they would care if you still offer an old version for compatibility sake.

Does their site say anything in a license agreement about they remain the only source for downloads? That also might only pertain to currently supported versions.

This might be just about the website content, but give it a glance.
