I got a new computer, my plan was to install EQ and run EQemu servers like last time. However, my questions are is it possible due the lastest patch breaking the emu code? Is there anyway I could not update the patches and just play emu? Or do all brand new players have to wait for this to get fixed?

You need to wait... ETA is 2007. With luck the Devs will get a release out before that, so pray or whatever.
