. 6. You shall not copy, modify, or distribute any EverQuest client software, nor shall you instruct or induce any other person copy, modify, or distribute any EverQuest client software, except that a server operator may modify a userĀ’s client data files (but not executable files) as approved by Daybreak in writing with the EQEmulator Administrator.
You do realize that virtually all popular emu server including both P99 and and especially Quarm/Al'Kabor violate this as they need to inject code via a .dll? It's essentially the same agreement as with P99/Quarm and I always wondered if Daybreak either does not know this detail or keeping it as a kill switch. Not including basic usability changes with at least the goal to keep compatibility with modern hardware and software is imho a big oversight. Now it's a arbitration thing at best and I rather doubt many of the emu server owners will like to kneel to both Daybreak and the Eqemu lead(s).

Until Akk ripped the cord out of the wall I was wondering why THJ was not simply kicked from the login server the moment they where going "commercial". This is so sad.

I actually had a chuckle over section 5 of the ToS

5. You shall not access, copy, modify, distribute, or use any Daybreak server-side software in connection with your development, testing, or operation of any EQEmulator server.

If you go to the EQEmu source github and scroll down to the README section "How we did it"

Reverse Engineering Every system, packet, opcode, and game mechanic has been reconstructed through countless hours of live packet sniffing, client disassembly, and in-game experimentation by dedicated contributors over the years.

In regards to #6, I think P99 violates this which makes the post come off really strange.

Last I recall, it’s anticheat and other tweaks to Titanium client, were a core part of the experience. Even its fog system.

I guess the question would be: is P99 getting rid of its anticheat and other tweaks to Titanium client in order to be in compliance?

Quarm is another interesting one. I think Zeal would technically be off the table but I don’t think they distribute Zeal. Not positive if they have tweaked eqgame itself

Default rule 7

7. All EQEmulator gameplay must remain exactly the same as the original EverQuest game. You shall not add, alter, or introduce any scripts, plug-ins, artwork, maps, assets, or other materials that change, extend, or replace the original EverQuest gameplay experiences, rules, mechanics, character traits, artwork, or strategies. Notwithstanding the foregoing, you are permitted to make minor changes or additions to add custom content (e.g., a new NPC, a new quest, a holiday event, etc.) provided that (i) you do not materially alter the difficulty of the game or fundamental gameplay mechanics, and (ii) by adding such custom content you agree to enforce a lower player cap as specified in Section 9, below.



Does this nuke almost every popular server outside a few?

Imho yes, "provided that (i) you do not materially alter the difficulty of the game or fundamental gameplay mechanics" is so broad that even a vanilla server with substantial faster EXP gain or EXP rebalancing for solo vs group play wpuld most likely violating the TOS.
