I'm a newbie to the forum but have been familiar with EQemu for some time. Anyway, for what its worth, I agree that using the actual EverQuest logo is only asking for SOE to turn their attention here. While they may "allow" EQemu to exist without hassling users to much, SOE may get a little testy over actual use of the logo.
It is interesting to note the following points since some hypocrisy seems to be happening here (ie using a program to emulate a server but worry about logo trademarks).

This has been covered many many times, go back and read where this has been discussed over and over again, because that coment shows you do NOT know the law / have a clue what can and cant be copywrited, OR hhow this EMU works, cause the code here is written by the Devs not SOE.

Obviously many of you don't know the law. By agreeing to the EULA (whether at installation or each time you play the game), you open yourself up to at the least a civil suit should SOE choose to press any violations. Now I don't really think they will unless there was a need for public relations, but here is where EQemu was in violation from its inception:
EULA
=============
9. You may not use any third party software to modify the Software to change Game play. You may not create, facilitate, host, link to or provide any other means through which the Game may be played by others,
such as through server emulators. You may not take any action which imposes an unreasonable or disproportionately large load on our infrastructure. You may not buy, sell or auction (or host or facilitate the ability to allow others to buy, sell or auction) any Game characters, items, coin or copyrighted material.
=============
You can say what you want about the way the software is engineered or designed, but the fact is that an emulator is explicitly prohibited in the EULA. It just doesn't get any plainer than that.
Also, you have used the word "EverQuest" at least once on the home page without the trademark symbol, and I'm sure in other places as well. If you want to check the trademark registration status, then [
click here ]. There are also several images from the game in the form of characters and such that are the copyrighted works of SOE as artistic works. Generally, SOE doesn't say anything about using them on websites and such, but they may have a different attitude if EQemu uses them directly in a logo or any derivations of them.
Now, do I really give a damn about all this? Nope. Do I think SOE really gives a damn about EQemu? Nope, unless a mass exodus to players took place, OR users began to complain and post on the SOE tech boards, OR users made jest of the fact that EQemu used a similar logo. Does my opinion really matter? Again, nope not in the least, but I thought I'd offer it anyway just for conversation.
