One way that they can charge you, is by taking legal actions and have a lawsuite against you. The judge in court would decide if the terms qualify and then determine if the offender(s) have to be punished. Then, there is a degree that the offender(s) can be punished.
The other way, is very much different, they'd have to make available, a notice that you have to pay to access, or to have possession of, or to gain possession of the product, service or otherwise. This one, does not involve any lawsuites or court. Basically, more or less what I am saying here is, like going to a site, to purcahse a server, it would have a page saying:
Purchase EQEmu Server (32 user license) for $29.95
Purchase EQEmu Server (64 user license) for $39.95
Purchase EQEmu Server (128 user license) for $129.95
And such, so you don't get roped in to anything, and they cannot be sued thereafter for unauthorized sales, etc. But for malicious activities, such as DoS (Denial of Service) attacks, Ping attacks, and other forms of malicious activities, they can, and warrant the rights to block, remove, revoke, or modify access to the offender(s), and also, to press charges and have every right to procescute the said offender(s) to the maximum extent allowed by law. Now I know, the law in each state may vary, and some do vary from one to the next, and then there is a "typical bylaw" that is the same for every state. The only thing that I can and will suggest, for additional information is to contact a lawyer that deals in this area so you know what your rights are.
The EQEmu Server project does reserve the right to press charges on the offenders, provided it is their
own servers, however. Now if it is not their servers, I believe they can still press charges for theft of content, services and such, but at another degree, the companies and/or individuals hosting the content, services, and such on their own servers, can as well, press charges, too! Then you'd have a double whamy from the hosting provider, and the people that are making the content, products, and services available. Know what I mean?
